Standard Terms and Conditions of Sale

Please note: All telephone calls may be recorded for training and quality monitoring purposes. All data is stored securely and in line with data protection regulations.

These Terms and Conditions apply to all agreements for the sale of goods by Songhurst Caravans. They take precedence over any other correspondence, terms, or representations made by the Purchaser unless changes have been expressly agreed in writing by the Seller.


Definitions

“Seller” refers to Songhurst Caravans and any current or future subsidiary companies or associated businesses.
“Purchaser” refers to the individual or legal entity buying goods from the Seller.
“Goods” refers to any vehicle or item the Purchaser agrees to buy from the Seller.
“List Price” refers to the current price list for the Goods, which may be updated from time to time.

1. Product Specification

1.1. All Goods will conform to their specifications within reasonable trade tolerances and will be free from material defects at the point of delivery.

1.2. The Seller may adjust product specifications to comply with legal requirements or manufacturer changes, provided these do not significantly affect performance or quality.

1.3. If the manufacturer discontinues the specific caravan or motorhome ordered, the Seller will cancel the contract and refund any deposit in full without further obligation.


2. Delivery

2.1. While the Seller will strive to meet estimated delivery dates, these dates are not guaranteed. The Seller is not liable for delays or associated losses.

2.2. Delivery is considered complete when the Purchaser is notified that the Goods are ready for collection. Ownership and risk transfer at this point.

2.3. Acceptance of delivery confirms the Purchaser’s agreement to these Terms and Conditions.

2.4. If the Purchaser unlawfully refuses delivery or breaches key terms of this agreement, the Seller may cancel the contract.


3. Price and Payment

3.1. Prices are as listed on the Seller’s current price list, website, quotation, or as otherwise agreed at the time of order.

3.2. Full payment must be made via bank transfer or debit card prior to delivery, including VAT and any applicable charges.

3.3. Delivery will not occur before the specified date unless an earlier date is mutually agreed.

3.4. Where finance is used to fund the purchase, an admin fee of up to £150 may be added.

3.5. If the Purchaser fails to make payment by the agreed date, the Seller reserves the right to cancel the agreement and retain any deposit paid.


4. Part Exchange

If the Seller accepts a used caravan or motorhome in part exchange, the following terms apply:

4.1. The vehicle must match the condition described by the Purchaser at the time of order, subject to fair wear and tear.

4.2. Any valuation provided is provisional and confirmed only after physical inspection by the Seller.

4.3. The vehicle must either (i) be fully owned by the Purchaser with no outstanding finance, or (ii) be subject to a finance agreement that can be settled by the Seller, in which case the part exchange allowance will be reduced by the settlement amount.

4.4. If the exchanged vehicle is sold before the new Goods are delivered and the sale is cancelled for any reason, the refund due to the Purchaser will not exceed the resale price of the exchanged vehicle.


5. Cancellations & Returns

5.1. The Purchaser must inspect the Goods immediately upon collection or delivery and notify the Seller within 24 hours of any faults or discrepancies.

5.2. Goods must be returned in a saleable condition. Any damage caused by the Purchaser may be chargeable.

5.3. The Seller is not liable for issues resulting from the Purchaser failing to follow user manuals or the Seller’s instructions.

5.4. Deposits are non-refundable in case of cancellation unless otherwise stated. The Purchaser’s financial liability is limited to the value of the deposit unless agreed in writing.

5.5. Upon cancellation, the Seller may dispose of the Goods at their discretion and is not required to refund any resale value to the Purchaser.


6. Distance Selling

6.1. For contracts agreed remotely (e.g., via phone, email, or website), the Purchaser has the right to cancel within 14 calendar days of receiving the Goods. Notification must be given in writing or by email.

6.2. The Purchaser is responsible for return shipping and insurance. A full refund will be issued within 30 days, less any delivery costs if originally waived.

6.3. Customised or made-to-order Goods are exempt from cancellation under this clause.

6.4. If the Purchaser visits the Seller’s premises at any point (e.g., to inspect or collect the vehicle), the sale is no longer considered a “distance contract” and standard in-person sales rules apply.


7. Notices

Any notice under this agreement must be delivered in person (with proof of delivery) or sent by recorded post. Notices sent by email are not valid.


8. Consumer Rights

Nothing in these terms affects the Purchaser’s statutory rights under consumer protection law.


9. Force Majeure

Neither party shall be liable for delays or failure to perform duties due to events beyond their reasonable control. These may include natural disasters, strikes, war, fire, supply shortages, or mechanical failure. Reasonable extensions will be granted.


10. Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining sections will remain in effect.


11. Data Protection

The Seller may store personal information for administrative and legal purposes. Data will be securely stored, accessed only as needed, and kept no longer than necessary. It will be protected against unauthorised access, misuse, or loss in accordance with data protection laws.
